What this means for a buyer

A council enters a site on its register under section 8 of the Derelict Sites Act 1990, after giving the owner notice and considering any objection. While it stays on, the council charges a levy of 7% of the site's market value every year, and it can buy the site compulsorily. That cost makes owners of registered sites more willing to sell, so the register is a steady source of infill land. Ask the council about any levy owed before you make an offer.

Who will collect the Derelict Property Tax?

Revenue. Budget 2026 announced a Derelict Property Tax, run by Revenue, to replace the council levy. It is not yet law. Until it starts, the council charges the levy.

Can an owner appeal?

The owner can object when the council gives notice that it intends to enter the site on the register. The levy itself can't be appealed, but the council's valuation can, to the Valuation Tribunal within 28 days.

How does a site come off the register?

The council removes the entry once it is satisfied the site is no longer derelict, usually after works or a new use.
