What this means for a buyer

Before a council sells or leases land, section 183 of the Local Government Act 2001 requires notice to every elected member, naming the land, the buyer and the price. The members consider it at a meeting at least ten days later and can vote to stop it. Most notices are small (garden strips, rights of way, tenant purchases), but some are development land going to a housing body, the Land Development Agency or a developer. The notice is often the only public record of a sale, so that is the time to ask the council about a site.

How a s.183 disposal works (Planning Register)

What is a section 183 notice?

A notice under s.183 of the Local Government Act 2001 from the chief executive to every elected member, at least ten days before a meeting, that the council proposes to dispose of land: the land, the buyer, the price and any conditions.

Can the councillors stop a sale?

Yes. At the meeting the members can resolve that the disposal shall not go ahead, or only on other terms. If they pass no such resolution, it proceeds.

Can the public object?

There is no statutory submission. The route is the local councillors, before the meeting, quoting the agenda item.

Does a s.183 notice mean the land will be built on?

No. It records a transfer of an interest in land. Any building needs planning permission in the ordinary way.

Where are s.183 notices published?

With the agenda for the council or area committee meeting on the council's meetings website. They are not in the planning register. Each row here links to its meeting papers.
